They either simply commit an offence under the Legal Service Act 2007 or they pass on your claim to a firm of solicitors. They may even ask you to sign the court papers yourself which means you will actually be a litigant in person. If they pass your claim to a firm of solicitors then you are engaging the tenant eviction company and a firm of solicitors. Either way they must arrange and pay for court representation. Yes if you instruct a firm of solicitors. Using solicitors means that legal costs can form part of your claim against the tenant. A litigant in person (without a solicitor on court record) is only able to seek recovery of the court fee and in some cases disbursements which cannot include "legal costs" for work done by an eviction firm that is not a firm of Solicitors.
